2. Scope of Application
These Terms and Conditions of Use and Sale (the “Terms”) govern the use of the website www.villahostels.com and any booking of accommodation and, where applicable, catering or ancillary services made through the website.
Any booking implies full and unconditional acceptance of these Terms by the customer.
3. Description of Services
The establishment provides accommodation services (youth hostel and hotel), as well as, where applicable, catering services, beverage services and ancillary services.
The essential characteristics of the services are presented on the website. Photographs and descriptions are provided for illustrative purposes only and are not contractually binding.
4. No Right of Withdrawal
In accordance with Article L221-28 of the French Consumer Code, the customer does not benefit from any right of withdrawal in respect of accommodation and catering services provided on a specific date or for a specific period.
5. Prices and Dynamic Pricing (Yield Management)
Prices are expressed in euros and include all applicable taxes, unless stated otherwise.
Prices may be subject to dynamic pricing adjustments, depending in particular on:
- the period of stay,
- occupancy levels,
- booking date,
- market demand.
This practice falls under yield management (dynamic pricing).
In accordance with the Opinion issued by the French National Consumer Council on 27 January 2020, customers are informed that such price variations do not constitute price reductions within the meaning of Article L.112-1-1 of the French Consumer Code.
The price applicable is the one displayed and confirmed at the time of booking. Once the booking is confirmed, the agreed price is no longer subject to change.
6. Booking and Payment
A booking becomes firm and final once the booking process has been completed and, where applicable, a payment or bank guarantee has been provided.
Accepted payment methods are specified during the booking process.
Depending on the selected rate, payment may be required in full or in part prior to arrival.
7. Cancellation, Modification and Guarantee
Cancellation and modification conditions (deadlines, applicable charges, refundable or non-refundable nature of the rate) are specified at the time of booking and vary depending on the rate selected.
It is the customer’s responsibility to carefully review the applicable conditions before confirming the booking.
8. No-show (Failure to Arrive)
In the event of failure by the customer to arrive on the scheduled date, without prior cancellation within the applicable deadlines, the establishment reserves the right to charge a flat-rate compensatory indemnity intended to compensate for the loss incurred due to the immobilisation of accommodation capacity and the loss of opportunity to resell the room.
This indemnity is independent of the price of the accommodation service.
As the service has not been provided, this amount does not constitute remuneration for a service, but compensation for a commercial loss.
9. Liability
The establishment shall not be held liable for non-performance or improper performance of the contract in the event of:
- force majeure,
- fault attributable to the customer,
- or an unforeseeable and unavoidable act of a third party.
10. Personal Data
Personal data collected through use of the website or the booking of services are processed in accordance with applicable regulations.
Customers are invited to consult the privacy policy available on the website.
11. Dispute Resolution – Mediation
In the event of a dispute, the customer is invited to contact the establishment first in order to seek an amicable solution.
In accordance with Article L612-1 of the French Consumer Code, consumers may refer the matter free of charge to a consumer mediation body.
